PERMANENT POSITION (Over 90 days).
- The Client shall pay to NCI a fee equivalent to 6.25% of the Candidate's agreed yearly salary. A permanent position is one that (a) the parties intend to last more than 90 days or (b) lasts more than 90 days after initial hire. Client shall pay NCI the fee for placement on receipt of invoice.
TEMPORARY POSITION (Under 60 days).
- The Client shall pay to NCI a fee equivalent to 25% of the total compensation paid to the Candidate. Monies shall be paid to NCI upon completion of employment. A Temporary position is one that the parties intend to last up to 60 days. Client shall pay NCI the fee for temporary placement on receipt of the invoice. A minimum charge of $100.00 will apply. If a temporary position becomes permanent the Client will be charged the rates as outlined above for a Permanent position. However, any fees paid for Temporary positions to NCI will be used towards the Permanent placement fee and will not exceed the permanent fee. There are no credits available for Temporary crew placements. Any Day workers employed will be charged for at a temporary fee. Should a day worker be successfully hired in a permanent or seasonal position as a result of NCI's Introduction either directly or indirectly through another day worker we have introduced to the vessel then the fee will be credited towards the permanent placement fee.
SEASONAL POSITION (Over 60 not more than 90 days).
- Any fees paid for the Seasonal position to NCI will be used towards the Permanent position fee and not exceed the permanent fee should the candidate be hired permanently. There is no credit for seasonal positions. Should the candidate not stay up to the agreed term but less than 90 days, NCI reserves the right to change the status of that placement to a Temporary Placement and to charge a Temporary fee of 25% of the total compensation paid, in accordance of the Fee Policy. Should the candidate stay past the 90 day period a Status of employment will be changed to a Permanent Placement and any monies outstanding between the seasonal position and the permanent position will be charged for but not exceeding the Permanent Placement fee of 6.25% of the candidates agreed yearly salary.

PAYMENT TERMS
- Full payment is due on receipt and payable within 14 days of invoice date and or date of employ or all Warranty Rights are waived. Merchant services: NCI makes the use of American Express cards available to clients, should this payment be preferred then invoice should be paid within 6 days of invoicing. Otherwise Visa or Master cards are available lines of payment. After 30 days, Client will be responsible to pay accrued interest of 1.5% per month plus reasonable costs of collection, including court costs, attorney fees, and/or collection agency fees. Acceptable methods of payment include credit cards, wire transfers and checks for services rendered. All Invoices served will be free of all financial institutional expenses and paid in full as per the total on the invoice. i.e: Wire transfer fees
All Candidates that have been hired through NCI regardless of the vessels trial period is due payment from the date of the invoice or date or employ.
TRAVEL & REPATRIATION EXPENSES
- Travel & repatriation expenses involved in the placement of a Candidate will be the responsibility of the Client. NCI is not responsible for any expenses incurred in the hiring process travel to a job location or the repatriation of a Candidate.
CONFIDENTIALITY
- Client agrees not to disclose or distribute any resumes information or other information received from NCI and/or the contents of such resumes and/or any Candidate information to any other person, or corporation other than for reference verification and employment. Should any Client do so is in breach of the terms and conditions herein. In the event of this infraction of this clause NCI will be entitled to charge a fee to the client of 4.75% of the candidate's yearly salary.
WARRANTY
- Provided all the conditions of this agreement are met by Client, in the event that a Permanent employee is unsuccessful in:

Ninety (90) days of employment: Should the candidate not complete a or be successful in the first Ninety (90) days term of employment then NCI will endeavor to replace the candidate as soon as possible, if requested. The replacement candidate will carry a warranty of thirty (30) days from embarkation. Should NCI be unsuccessful in locating a suitable replacement candidate then a credit will be made to the clients account to be used against a single placement within a 12 month period from the date of original Invoice date or start date, whichever is first.

All fees paid are non-refundable and one credit per placement applies.
CREDIT
- Will not be granted if there has been a substantial or material change in employment conditions aboard the vessel from the time the Candidate was hired. This would include but not limited to: (a): change of ownership, (b): change of Captain or a change of 50% of crew compliment, (c): significant change in job description / expectations, (d): unsafe practices, (e): failure to pay invoice within 14 days of invoicing date, (f): major change in itinerary, (g): not maintaining a drug free work environment and (h): NCI has been informed of termination of employment within 48 hours prior to departure and reasons given. (i): When the employer is otherwise in default of this agreement.
CANDIDATE INTRODUCTION
- (a): Should a crew member be submitted by NCI and be previously known to the employer, through introduction by another paid placement service, it is the burden of the employer to notify NCI within 24 hours of receipt of the candidate's information. If notification is not received within 24 hours then it shall be viewed as a valid introduction and fees payable.
(b): Should the employer also be searching for crew online using web searches or listing services it is the burden of the employer to disclose the names of any crew member already under consideration. Any crew member submitted by NCI who has not previously been declared by the employer will be viewed as a valid introduction and fees payable. This clause is to avoid an employer using our service to validate the quality of a crew member whose resume is online and avoid paying a fee.
(c): In situations where the candidate is known of to the employer but the employer did not have the correct contact information a full placement fee is payable.
JOB ORDERS
- Any company or representative of the company that places a job order shall be deemed as accepting the terms and conditions set forth in this document. NCI will require a credit card to secure a job placement request. However it will only be charged in full if payment for invoiced total is not received within thirty (30) days from the candidate embarking the Vessel.
INFORMATION PRESENTED
- NCI makes all reasonable efforts to ensure that the information is accurate and correct prior to forwarding information to an employer; however, due to the fact that the information is being entered by individual crew members from various locations, it is agreed that no guarantee as to the accuracy of information presented is expressed or implied. It is strongly recommended that any employer verify the credentials and job history of any applicant prior to hiring.
